WHAT IS A FOOD SERVICE LICENSE?

 

If your business is serving food then you need a food service license. But in many states, the license is based on the type of restaurant you have. For example, dine-in restaurants might be licensed by the number of seats they have. Food trucks still needs FSSAI/food service license, but that license will be called a food vendor’s license.

 


Type of Food Service/ Description


Temporary


A temporary food service establishment means an establishment which operates at a fixed location for temporary period of time which is not more than two weeks.

Fixed


A fixed establishment is a facility that has a permanent location. This is an operation where food/ drink is prepared for direct consumption through service on premises or elsewhere, and any other eating, drinking establishment/ operation where food is served/ provided for public.

Mobile


A mobile food service establishment means a food service establishment operating from the vehicle like trailer/watercraft which is not fully equipped for the full food service &, so, must return to the licensed commissary at least once in every 24 .

Special Transitory Food Unit STFU


An (STFU) is a temporary food establishment licensed to operate throughout state without 14 days limit or a mobile food establishment that is not required to return to commissary for servicing and maintenance.




FSSAI Registration


Documents Required for FSSAI Registration


IFSSAI registration is mostly applicable for petty food retailers, and the procedure of registration is very simple.
The documents required for FSSAI registration are:
• Photo of Food Business Operator.
• Document for Identity Proof like Ration Card, Voter ID Card, PAN Card, Driving License, Passport, Aadhar Card, Senior Citizen Card, Department Issued ID.
• Supporting Documents (if any):- NOC by Municipality or Panchayat, Health NOC.

Central FSSAI License – Eligibility & Documents Required


Central FSSAI license from the Food Safety and Standards Authority of India is required for all certain food businesses involved in the manufacturing, storage, distribution, transportation or retailing of food products. Based on the nature of activity of the business, the FSSAI License could be issued by the State FSSAI Regulator or Central FSSAI Regulator. In this article, we only look at the eligibilty and documents required for obtaining Central FSSAI License.

Central FSSAI License – Eligibility & Documents Required


Central FSSAI license from the Food Safety and Standards Authority of India is required for all certain food businesses involved in the manufacturing, storage, distribution, transportation or retailing of food products. Based on the nature of activity of the business, the FSSAI License could be issued by the State FSSAI Regulator or Central FSSAI Regulator. In this article, we only look at the eligibilty and documents required for obtaining Central FSSAI License.




Eligibility for Central FSSAI License



• Dairy units including milk chilling units equipped to handle or process more than 50,000 litres of liquid milk per day or 2500 MT of milk solid per annum.
• Vegetable oil processing units and units producing vegetable oil by the process of solvent extraction and refineries including oil expeller unit processing more than 2 MT per day.
• Slaughtering units which handle more than 50 large animals or 150 small animals or more than 1000 poultry birds per day.


• All food processing units including relabellers and repackers processing more than 2 MT per day except grains, cereals and pulses milling units.
• All manufacturers of proprietary foods.
• All 100% Export Oriented Units.
• All importers importing food items including food ingredients and additives for commercial use
• Storage units other than those having controlled atmosphere and cold environment having capacity of more than 50,000 MT.


• Cold or Refrigerated Storage having capacity of more than 10,000 MT.
• Controlled Atmosphere + Cold Storage having capacity of more than 1,000 MT.
• Wholesalers having turnover of more than Rs.30 crores per annum.
• Retailers having turnover of more than Rs.20 crores per annum.
• Distributors having turnover of more than Rs.20 crores per annum.


• Suppliers having turnover of more than Rs.20 crores per annum.
• Caterers having turnover of more than Rs.20 crores per annum.
• Hotels – Five Star & Above.
• Restaurants having turnover of more than Rs.20 crores per annum.
• Transporters having more than 100 vehicles or turnover of more than Rs.30 crores per annum.


• Marketers having turnover of more than Rs.20 crores per annum.
• Food catering services in establishments and units under Central Government Agencies like Defence, etc.,
• Storage or Wholesalers or Retailers or Distributors having premises in Central Government Agencies.


• Food catering services at seaport located at Kandla, Tuticorin, Vishakhapatnam, Kolkata, Marmagoa, Cochin, Mumbai, Chennai, JNPT and/or airport located at Kolkata, Trichy, Mumbai, Delhi, Chennai, Amritsar, Cochin, Bengaluru, Hyderabad, Trivendrum and Ahmedabad.




Documents Required for Obtaining Central FSSAI License



1. Form- B completed and signed by the Proprietor or Partner or Authorized Signatory.
2. Blueprint/layout of the processing unit showing the dimensions and operation-wise area allocation (Mandatory for manufacturing and processing units only).
3. List of Directors / Partner / Proprietor / Executive Members of Society / Trust with full address and contact details (Mandatory for Companies only).


4. Name and list of equipments and machinery along with the number, installed capacity and horse power used (Mandatory for manufacturing and processing units only).
5. Photo identification and address proof issued by the Government for Proprietor / Partner / Director(s) / Authorized Signatory (Optional).
6. List of food category desired to be manufactured. (For manufactures only).


7. Authority letter with name and address of responsible person nominated by the manufacturer along with alternative responsible person indicating the powers vested with them viz assisting the officers in inspection, collection of samples, packing and dispatch. (For manufacturers and processors).
8. Analysis report (Chemical & Bacteriological) of water to be used as ingredient in food from a recognized / public health laboratory to confirm the portability.


9. Proof of possession of premises (Sale deed / Rental Agreement / Electricity Bill) (Optional).
10. Partnership Deed or Declaration for Proprietorship or MOA & AOA along with Certificate of Incorporation and List of Directors with address. In case of Company, three pages must be uploaded: First Page – Certificate of Incorporation, Second Page – Authorization of food business activity and Third Page – List of Directors with addresses).


11. Copy of certificate obtained under Coop Act – 1861 / Multi State Coop Act – 2002 in case of Cooperatives. (If applicable).
12. NOC & Copy of License from manufacturer (Mandatory for Relabellers and Repackers).
13. Food Safety Management System Plan or Certificate (if any).


14. Source of milk or procurement plan for milk including location of milk collection centres in case of milk and milk products processing units. (if applicable).
15. Source of raw material for meat and meat processing plants. (if applicable).
16. Pesticide residues report of water in case of units manufacturing packaged drinking water, packaged mineral water and/or carbonated water from a recognized / public health laboratory.


17. Recall plan wherever applicable, with details on whom the product is distributed (optional).
18. NOC from Municipality or Local Body (optional).
19. Ministry of Commerce Certificate for 100% EOU.


20. Supporting documentary proof of turnover.
21. NOC/PA documents issued by FSSAI.
22. IE Code document issued by DGFT.
23. FSSAI Form IX: Nomination of Persons by a Company along with the Board Resolution.


24. Certificate provided by Ministry of Tourism (HRACC). (Mandatory for Hotels).
25. Documentary proof of turnover or self declaration of number of vehicles (Mandatory for Transporters).
26. FSSAI Declaration Form.





Documents Required for FSSAI State License



1. Form-B duly completed and signed (in duplicate) by the proprietor, partner or the authorised signatory.
2. Blueprint or layout plan of the processing unit showing the dimensions in metres or square metres and operation-wise area allocation (mandatory for manufacturing and processing units only).
3. List of directors, partners, executive members of society or trust with full address and contact details (mandatory for companies only)


4. Name and list of equipment and machinery along with the number, installed capacity and horsepower used (mandatory for manufacturing and processing units only)
5. Identity and address proof issued by Government authorities for proprietor, partner, director(s) or authorised signatory
6. List of food category desired to be manufactured. (In case of manufacturers)


7. Authority letter with name and address, the responsible person, nominated by the manufacturer along with alternative responsible person indicating the powers vested with them viz assisting the officers in inspections, collection of samples, packing & dispatch (for manufacturers or processors)
8. Analysis report (Chemical & Bacteriological) of water to be used as an ingredient in food from a recognized or public health laboratory to confirm the portability (mandatory only for manufacturing and processing units)


9. Proof of possession of premises. (sale deed, rent agreement or electricity bill, etc.)
10. Partnership deed, affidavit of proprietorship or Memorandum and Articles of Association towards the constitution of the firm. (optional)
1. FSSAI Self-declaration for proprietorships.
11. A copy of the certificate obtained under Coop – 1861 or Multi-State Coop Act – 2002 in case of cooperatives.

Advantage of FSSAI License


In this age of information & technology, consumers are becoming more aware about food quality, hygiene and standard. Before purchasing any food from outside, consumers prefer to have food which has FSSAI compliant which made them more assured in aspect of the food quality, and contamination. In addition to this, this gives the consumer a valid proof to complain if there is anything wrong with the food that is sold to him. So with the fear of legal actions there is less chance of the food quality being poor among the sellers having Food Safety license. Thus having a Food License gives you a clear advantage to increase the consumer base at faster rate.
Most of the businesses find that getting a food license registration online is time consuming and expensive and an inconvenient process of documentation, thus they try to avoid getting license. But, in reality, the process is not so cumbersome and there are lots of consultancies that can help you in getting the license with ease. The actual cost which is required in order to achieve license is less than what you will have to pay for it as penalties if you are caught. It is thus advisable for any businessman to first get the license before you can even officially open your business.
Once you have the license, you can skillfully use FSSAI logo in your menu cards and also in the pamphlets in order publicize your food’s superior quality over others. This, however, gives you an edge over to the many food operators who don’t have a FSSAI. All packaged FSSAI are thus required to have an FSSAI number. The logo is seen as a mark of validity and also for assurance for consumers. In fact, the selective customers want to consumes food products specifically who are having license. It helps you in developing a brand name.

Type of Food License

BASIC : If your business has an Annual Income less then Rs. 12 lakh you need this Basic Registration which has a validity of 1 to 5 years. Fees of this license is Rs. 100 per year.

STATE : If your business has an Annual Income between Rs. 12 Lakh to 20 Cr. You need this State License which has a validity of 1 to 5 years. Fees of this license is Rs. 2000 to 5000 per year it depends upon your production.

CENTRAL : If your business has an Annual Income more than Rs. 20 Cr. You need this Central License which has a validity of 1 to 5 years. Fees of this license is Rs. 7500 per year.
